These Terms of Service (“Terms”) govern your access to and use of lovearmy.com and your purchase of products from LOVE ARMY Lifestyle Corp. (“LOVE ARMY,” “we,” “us,” or “our”). By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms, together with our Privacy Policy and Shipping & Returns Policy.If you do not agree with these Terms, please do not use the website or purchase products from LOVE ARMY.

1. ABOUT LOVE ARMY

LOVE ARMY Lifestyle Corp. is a corporation organized and existing under the laws of the Republic of the Philippines.

LOVE ARMY operates the website lovearmy.com and sells apparel, accessories, lifestyle products, collaborations, and related merchandise.

2. ELIGIBILITY

By using this website or placing an order, you represent that you are legally capable of entering into a binding agreement under applicable law.

If you are purchasing on behalf of another person or entity, you represent that you have the authority to do so.

3. PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, colors, dimensions, measurements, materials, and other information displayed on the website are accurate.

However:

  • Actual colors may vary depending on your screen or device;
  • Measurements may vary within reasonable manufacturing tolerances;
  • Product photography may include styling, lighting, or display elements not included with the product;
  • Packaging may vary;
  • Manufacturing, dyeing, printing, washing, embroidery, finishing, or other production processes may result in minor variations between individual products; and
  • Product specifications may change where reasonably necessary for production, quality, availability, safety, or other legitimate business reasons.

Minor variations that do not materially affect the product are not considered defects.

Nothing in this section limits any rights or remedies relating to products that are defective, materially different from their description, incorrectly supplied, or otherwise non-conforming under applicable law.

4. PRODUCT AVAILABILITY

All products are subject to availability.

LOVE ARMY may limit quantities, discontinue products, change availability, or modify product specifications at any time.

Certain products may be limited edition, event-based, preorder, backorder, made-to-order, or produced in limited quantities.

Placement of a product in your cart does not guarantee availability.

Where a product is offered in limited quantities, LOVE ARMY does not guarantee that additional units will be produced or made available after the stated quantity or ordering period has ended.

5. PRICES

Prices are displayed in the currency indicated on the website.

LOVE ARMY reserves the right to correct pricing, typographical, product, currency-conversion, or technical errors.

If a material pricing error occurs, LOVE ARMY may contact you before fulfillment and provide the option to confirm the order at the correct price or cancel the affected order.

Applicable taxes, duties, customs charges, shipping charges, payment-processing charges, currency-conversion charges, or other fees may apply depending on the destination, payment method, and transaction.

Any applicable additional charges will be disclosed where reasonably practicable.

6. ORDERS

Submitting an order constitutes an offer to purchase the selected products.

An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance by LOVE ARMY.

LOVE ARMY may decline, cancel, or limit an order where reasonably necessary, including where:

  • A product is unavailable;
  • A pricing or listing error occurred;
  • Payment cannot be verified;
  • Fraud or unauthorized activity is suspected;
  • Shipping restrictions apply;
  • The order exceeds applicable quantity limits;
  • The order appears to be intended for unauthorized resale or commercial activity;
  • The customer has previously engaged in fraudulent, abusive, or materially disruptive transaction activity; or
  • Other legitimate circumstances require cancellation.

If LOVE ARMY cancels a paid order for a reason attributable to LOVE ARMY, the applicable amount will be refunded using the original payment method where reasonably practicable, subject to applicable law and payment-provider procedures.

LOVE ARMY is not responsible for delays caused by a payment provider, bank, payment gateway, courier, customs authority, or other third party after an order has been successfully submitted.

7. PAYMENT

Orders must be paid using the payment methods made available during checkout or otherwise expressly approved by LOVE ARMY.

You authorize LOVE ARMY and its payment service providers to process the payment associated with your order.

LOVE ARMY may refuse or suspend fulfillment where payment has not been successfully completed or verified.

An order is not considered fully confirmed or ready for fulfillment until payment has been successfully received or otherwise verified by LOVE ARMY.

Where a payment is reversed, rejected, disputed, charged back, or otherwise withheld after an order has been fulfilled or committed to production, LOVE ARMY reserves all rights and remedies available under applicable law.

8. PREORDERS AND BACKORDERS

Some products may be available only through preorder or backorder.

Preorder and backorder products may be produced, procured, allocated, or otherwise committed specifically in response to customer orders and may therefore require a longer fulfillment period than ordinary in-stock products.

Each preorder or backorder may have an applicable order cut-off date, which will be stated on the relevant product page, announcement, checkout information, or other applicable communication.

Order Cut-Off and Production Commitment

The customer acknowledges that the cut-off date is the point at which LOVE ARMY may finalize quantities and commit to production, procurement, materials, manufacturing capacity, supplier arrangements, event allocations, or other costs associated with fulfilling the orders received.

Once the applicable cut-off date has passed, the order may be treated as a committed production or procurement order.

Accordingly, after the applicable cut-off date, cancellation or refund requests based solely on a change of mind, failure to wait for the stated production period, preference for another product, incorrect size selection, or other reasons unrelated to a defect, non-conformity, or failure attributable to LOVE ARMY will generally not be accepted.

This applies even if the product has not yet been completed, received by LOVE ARMY, or shipped to the customer.

The fact that an item remains in production or has not yet been dispatched does not, by itself, mean that the order remains cancellable.

Production and Fulfillment Period

Estimated production, completion, and dispatch dates are estimates and are not guaranteed delivery dates unless expressly stated otherwise.

By placing a preorder or backorder, you acknowledge and accept that fulfillment may take longer than ordinary in-stock purchases.

Production or fulfillment may be affected by manufacturing schedules, material availability, quality control, supplier circumstances, logistics, customs, transportation, weather, events, labor disruptions, or other circumstances beyond LOVE ARMY’s reasonable control.

Where a production or fulfillment delay occurs, LOVE ARMY will provide reasonable updates when material information becomes available.

A delay within a stated or subsequently communicated production or fulfillment period does not, by itself, constitute grounds for cancellation or refund where the order remains capable of fulfillment.

Where LOVE ARMY becomes unable to fulfill a paid preorder or backorder for reasons attributable to LOVE ARMY, the customer will be provided with the remedy required under applicable law and/or the applicable product or order policy.

Nothing in this section limits rights or remedies that cannot legally be excluded.

LOVE ARMY collects and processes personal information in connection with your use of the website, account registration, orders, payments, customer service interactions, shipping, returns, promotions, and other legitimate business activities.

Personal information may include information such as your name, email address, telephone number, billing information, shipping address, order information, transaction details, and other information reasonably necessary to provide our products and services.

Fulfillment and Logistics Providers

By placing an order with LOVE ARMY, you acknowledge and authorize LOVE ARMY to provide the personal information reasonably necessary to fulfill and deliver your order to third-party logistics providers, freight forwarders, couriers, shipping carriers, fulfillment centers, warehouses, customs brokers, and other service providers involved in processing, handling, transporting, clearing, or delivering your order.

This may include your:

  • Name;
  • Shipping and delivery address;
  • Email address;
  • Telephone or mobile number;
  • Order number and order details;
  • Package and shipment information; and
  • Other information reasonably necessary to complete delivery, customs clearance, returns, or related fulfillment services.

These third parties may process your information on LOVE ARMY’s behalf or as otherwise permitted under applicable law and are expected to handle personal information in accordance with applicable privacy and data-protection requirements.

LOVE ARMY may also disclose relevant information to payment processors, fraud-prevention providers, technology providers, customer-service providers, accounting providers, professional advisers, government authorities, customs authorities, and other service providers where reasonably necessary to operate the business, process transactions, comply with law, protect our rights, or provide the services requested by the customer.

International Transfers

Because LOVE ARMY serves customers internationally and may work with logistics, payment, technology, fulfillment, and other service providers located in countries outside the Philippines, your personal information may be transferred to, stored in, or processed in jurisdictions outside the Philippines.

Where required by applicable law, LOVE ARMY will implement appropriate safeguards for such transfers and processing.

Privacy Policy

Our Privacy Policy provides additional information regarding the categories of personal information we collect, the purposes and legal bases for processing, categories of recipients, retention periods, international transfers, cookies and similar technologies, marketing communications, data-security measures, and your rights as a data subject.

By using the website or placing an order, you acknowledge that you have been provided access to the Privacy Policy.

Nothing in these Terms limits any rights available to you under applicable data-protection or privacy laws.

9. ORDER CHANGES AND CANCELLATION

Cancellation and order-change rights are subject to the applicable product listing, Shipping & Returns Policy, these Terms, and applicable law.

Requests to change an order, including changes to:

  • Size;
  • Color;
  • Product;
  • Quantity;
  • Shipping address;
  • Recipient information; or
  • Other order details

may only be accommodated before the order reaches the applicable stage of production, fulfillment, packing, dispatch, or transit.

LOVE ARMY does not guarantee that requested changes can be accommodated once an order has been submitted.

Orders may become non-cancellable once they enter production, fulfillment, customization, packing, or transit.

For preorders and backorders, the applicable cut-off-date provisions in Section 8 apply.

Where a customer requests cancellation after an order has become non-cancellable, LOVE ARMY may decline the request to the extent permitted by applicable law.

10. SHIPPING

Shipping is governed by our Shipping & Returns Policy.

Customers are responsible for providing accurate and complete shipping information, including the recipient’s name, address, postal code, telephone number, and other information reasonably required for delivery.

LOVE ARMY is not responsible for delivery failure, delay, additional charges, or loss resulting from incorrect or incomplete information supplied by the customer.

Once an order has been handed to the applicable carrier, delivery timing is primarily subject to the carrier’s operations.

For international shipments, customers are responsible for complying with applicable import requirements and paying applicable duties, taxes, customs charges, brokerage fees, or other destination charges unless expressly stated otherwise.

Shipping estimates are not guarantees of delivery by a particular date unless expressly stated otherwise.

11. FAILED, REFUSED, OR UNCLAIMED DELIVERIES

If a customer refuses delivery, fails to claim a package, provides an incorrect or incomplete address, or otherwise causes a shipment to be returned to LOVE ARMY or the sender, any applicable additional shipping, storage, redelivery, customs, handling, or return-to-sender charges may be charged to the customer to the extent permitted by law.

Where a returned order is eligible for reshipment, LOVE ARMY may require payment of applicable additional shipping costs before resending the order.

For orders that remain unclaimed or cannot be successfully delivered after reasonable attempts, LOVE ARMY may treat the order in accordance with the applicable Shipping & Returns Policy and applicable law.

12. RETURNS AND REFUNDS

Returns, exchanges, refunds, defective-product claims, and cancellations are governed by the LOVE ARMY Shipping & Returns Policy.

LOVE ARMY may establish reasonable return procedures, deadlines, documentation requirements, and eligibility conditions for voluntary returns, exchanges, or change-of-mind requests, subject to applicable law.

Nothing in these Terms or the Shipping & Returns Policy is intended to exclude rights or remedies that cannot lawfully be excluded under applicable law.

In particular, restrictions on change-of-mind cancellations or returns do not prevent a customer from exercising applicable rights relating to defective, damaged, incorrectly supplied, materially non-conforming, or otherwise legally defective products.

13. SIZE SELECTION AND CUSTOMER-PROVIDED INFORMATION

Customers are responsible for reviewing applicable size charts, measurements, product descriptions, and other information before placing an order.

Selecting an incorrect size, color, variant, or other product option does not constitute a product defect.

Where LOVE ARMY provides size charts or measurements, reasonable manufacturing tolerances may apply.

LOVE ARMY is not responsible for an unsuitable fit resulting solely from the customer’s failure to review or correctly interpret the applicable product information, subject to any rights available under applicable law.

14. CHARGEBACKS AND PAYMENT DISPUTES

Customers agree to contact LOVE ARMY first regarding any billing, payment, order, delivery, or product concern before initiating a payment dispute or chargeback, where reasonably practicable.

A chargeback or payment reversal does not automatically cancel an order or release the customer from payment obligations.

Where a payment dispute is initiated in relation to a legitimate transaction, LOVE ARMY may provide the relevant transaction records, order information, communications, delivery information, tracking information, and other documentation to the applicable payment provider or financial institution.

Nothing in this section prevents a customer from exercising rights available under applicable law.

15. INTELLECTUAL PROPERTY

All content appearing on lovearmy.com, including but not limited to:

  • LOVE ARMY trademarks and logos;
  • Product designs;
  • Graphics;
  • Artwork;
  • Photography;
  • Videos;
  • Text;
  • Website layouts;
  • Product names;
  • Branding;
  • Illustrations;
  • Original creative works; and
  • Other materials

is owned by LOVE ARMY or its respective licensors and is protected by applicable intellectual property laws.

LOVE ARMY®, its logos, branding, and related marks may not be reproduced, copied, modified, distributed, displayed, or used commercially without prior written authorization.

Third-party intellectual property appearing in licensed or collaborative products remains the property of its respective owners.

Nothing on this website grants you ownership of or a license to any LOVE ARMY or third-party intellectual property except for the limited right to access and use the website for its intended purposes.

16. LIMITED LICENSE TO USE THE WEBSITE

LOVE ARMY grants you a limited, revocable, non-exclusive, non-transferable license to access and use lovearmy.com for personal and lawful purposes.

You may not:

LOVE ARMY may suspend or terminate accounts where reasonably necessary to protect the website, customers, or business.

18. REVIEWS AND USER CONTENT

If you submit reviews, photographs, comments, or other content to LOVE ARMY, you represent that:

  • You have the right to submit the content;
  • The content does not violate another person’s rights;
  • The content is not unlawful, defamatory, fraudulent, abusive, or misleading; and
  • The content does not contain malicious code or unauthorized personal information.

By submitting content, you grant LOVE ARMY a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, adapt, and distribute that content for legitimate LOVE ARMY business, marketing, promotional, and operational purposes.

LOVE ARMY may remove or decline to publish content at its discretion where reasonably necessary.

  • LOVE ARMY may correct obvious errors or withdraw an offer where necessary due to technical, pricing, fraud, or other legitimate issues, subject to applicable law.

Customers are responsible for ensuring that the email address and other contact information provided to LOVE ARMY remain accurate and accessible.

24. DISCLAIMER

To the maximum extent permitted by applicable law, the website and its content are provided on an “as available” and “as is” basis.

LOVE ARMY does not guarantee that the website will be uninterrupted, error-free, completely secure, or free from harmful components.

Nothing in these Terms excludes any consumer rights, warranties, or remedies that cannot legally be excluded or limited.

25. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, LOVE ARMY will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of the website or purchase of products.

LOVE ARMY will not be responsible for losses, delays, or failures caused by circumstances outside its reasonable control, including third-party payment providers, carriers, customs authorities, suppliers, manufacturers, or other service providers, except to the extent liability cannot legally be excluded.

Where liability cannot lawfully be excluded, LOVE ARMY’s liability will be limited to the extent permitted by applicable law.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

26. INDEMNIFICATION

To the maximum extent permitted by law, you agree to indemnify and hold harmless LOVE ARMY, its officers, directors, employees, representatives, affiliates, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines, without prejudice to mandatory consumer protection rights that may apply to customers in their respective jurisdictions.

29. DISPUTES

LOVE ARMY encourages customers to contact us first so that we may attempt to resolve concerns promptly and in good faith.

Nothing in these Terms prevents a consumer from exercising rights or remedies available under applicable law or from pursuing remedies before an appropriate government agency, court, or dispute-resolution mechanism.

Where legally permitted, disputes shall be subject to the appropriate courts or dispute-resolution mechanisms in the Philippines.

30. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.

31. NO WAIVER

Failure by LOVE ARMY to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision or any other provision later.

32. CHANGES TO THESE TERMS

LOVE ARMY may update these Terms from time to time.

Updated Terms will be posted on this page with a revised “Last Updated” date.

Changes will generally apply prospectively to transactions occurring after the updated Terms are posted, unless otherwise required or permitted by applicable law.

Your continued use of the website after an updated version is posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.
